This site is based on chayns by Tobit.Labs, a professional platform that connects people, companies and organizations. Tobit.Labs is responsible for the technical operation of the platform and for compliance with data protection regulations when using the platform. The following declaration extends to the collection and use of personal data within the meaning of the Data Protection Act, which Tobit.Labs may collect when using chayns.

1. Principles of Tobit.Labs

The protection of your privacy and personal data is very important to us as a manufacturer of standard software that is used by millions of people. We therefore treat personal data confidentially and in accordance with the statutory data protection regulations and this data protection declaration.

 

Our top priority is data economy. This means: We do not want any personal data that is not absolutely necessary. This site can therefore also be used completely anonymously. For the best possible user experience and the provision of comfort functions, it may be necessary to enter personal data. They are requested in the context in which they are needed.

This applies to the data collected by Tobit.Labs on the platform. An exception to this is data collection by the site operator itself, which is done at your own initiative and for which you are responsible (see 9.). Tobit.Labs has no influence whatsoever on the type of data collection by the operator.

3. Collection, processing and use of personal data by Tobit.Labs

You can visit and use chayn's sites, which appear as a website or app, without providing any personal information. However, if you register with chayns in order to use advanced functions such as the intercom, you can do this in various ways that require data on a regular basis. This is done either by registering by email or mobile number or by using single sign-on procedures (SSO) via Facebook, Instagram, Twitter, Google, Microsoft or Amazon.

Which data is transferred during SSO registration is regulated by the respective provider, who shows you this when you register and asks you for your consent. The SSO procedure is only used to simplify registration. If you do not want data to be transmitted via an SSO provider, we recommend that you register by email.

3.1 Registration by email or mobile number

In order to register by e-mail or mobile number, we need your first and last name and the e-mail address or mobile number via which you will receive the confirmation link or confirmation SMS to be able to address you correctly. You can then log in to all chayns sites at any time using this login.

3.2 Registration via SSO

When registering via the SSO procedure, the respective provider will show you what data is being transmitted the first time you use it. Tobit.Labs only requests the required information. The respective provider specifies some mandatory information. The information that is transmitted and stored is the first name, last name and, if applicable, the profile picture and/or the e-mail address if they are provided. They are used for clear assignment to a chaynsID. Some information can also be optionally deselected by you. If you do not want this type of data transmission, we recommend that you register by email or mobile number. In addition, the respective providers provide linked data protection declarations for use, which, among other things, also contain information on deactivating or deleting the log in link. You can remove the link to your chaynsID in the respective user accounts of the SSO providers at any time. The providers may be informed that there is a link to chaynsID. For more information, please refer to the respective data protection regulations of the respective provider.

With both registration methods, the date and time of registration is also saved. With some applications under chayns it is possible to search for a chaynsID using the person finder and, for example, assign it to a message and/or add it to a user group. During the search, the profile picture that may be available and the first and last name you have stored in the master data are displayed. Data processing during the registration and use of chayns takes place to fulfill the user contract in accordance with Article 6 (1) (b) GDPR .

4. Other data that you can voluntarily provide

By registering you will receive your personal chaynsID. This is a virtual user account. There you can enter and save further data, such as your address. The purpose of this is that, for example, correct invoicing and delivery is only possible in this way and is therefore relevant in terms of tax and commercial law. You provide this data voluntarily and is not necessary if you do not make any purchases. The data is linked to the respective purpose of use by you. You can also voluntarily enter your date of birth there. The reason for this is that sites that you visit regularly have the option of automatically sending you a birthday voucher, for example. If you do not want this, simply do not enter a date.

The processing of this information takes place to fulfill the respective usage contract with you and the site on the basis of Art. 6 Para. 1 lit b DSGVO. In addition, you can also store your license plate number in your personal area in order to automatically receive minute-by-minute billing from the PRKN system. For more information, see Du  here . This processing and also the automated license plate recognition through automated camera image analysis on the respective participating parking spaces also takes place on the basis of Art. 6 Para. 1 lit b DSGVO. You can remove the indicator from your chaynsID yourself at any time. The collected date (number plate) is of course earmarked. If you do not want this data collection, we recommend that you do not leave your license plate number and do not enter the respective parking spaces.

If the site releases the feature, there will be an opportunity to interact. This means that you can comment or "like" posts. With the comment, your profile picture, the date, as well as your first and last name will be publicly visible. However, you can remove the post yourself at any time. If a post is liked, the site operator receives the same data, but these are not public. By clicking on the Like button again, you can undo this data collection. This data processing is based on the fulfillment of the user contract from Art. 6 Para. 1 lit b DSGVO. If you do not delete this data yourself, this processing will continue.

You can also order goods, services or tickets via the chayns eShop. The business transaction, including payment processing and typically with automatic document creation, runs via die  chayns OPM GmbH   by way of fine trading (buying and selling in real time). The chayns OPM GmbH is a 100% subsidiary of Tobit.Labs with the same company headquarters (group). For a more detailed explanation of the fine trading of chayns OPM GmbH, click  here . Due to fine trading, the description of goods or services, the time of purchase and the IP address are also transmitted and stored. This serves to fulfill the contract and for billing. The deletion periods under commercial law therefore apply. The data is also processed to fulfill the contract in accordance with Art. 6 Para. 1 lit b GDPR. The possibly necessary data transfer from Tobit.Labs to chayns OPM GmbH takes place on the basis of the legitimate interest of Art. 6 Para. 1 lit f DSGVO in conjunction with recital 48. To top up the account, we may need your payment details in the form of bank details for issuing a direct debit mandate. However, a top-up can also be done using a credit card, direct debit, PayPal, Google Pay or Apple Pay. When making a payment via these services, the data can be validated, e.g. whether the first four check digits of the IBAN are correct. For more information, please refer to the respective data protection regulations of the individual providers, which are displayed in the form of a pop-up with every charging process. The top-up by credit card is processed via stripe. For more information about stripe and their privacy policy, see  here . Insofar as data is passed on to external service providers, we have ensured through technical and organizational measures, as well as order processing contracts, that the data protection regulations are observed.

5. Site Creation Data

If you set up a chayns site, we may need additional data if, for example, optional modules are purchased or subscribed to. But this is not a requirement. In this case, your address for invoicing and your bank details for payment processing will be requested and processed. This is done to process and fulfill the contractual relationship in accordance with Art. 6 Para. 1 lit b GDPR. The deletion periods under commercial law apply. The operation of the chayns site is basically possible without storing further data (measured by setting up a personal account). If you book additional services such as the Primesite, your payment details will be required for processing. The statements under 4 apply.

6. Communication channels

If, for example, you contact us via the InterCom or by email, we will only use the personal data you provide to process your request and will, of course, treat your data confidentially and for the specific purpose. The data will be deleted as soon as they are no longer required to achieve the purpose. Newsletters or intercom messages are based on your settings. This processing operation takes place on the one hand to fulfill the user contract according to Art. 6 Para. 1 lit b DSGVO, as well as due to our legitimate interest in the provision of information according to Art. 6 Para. 1 lit f DSGVO. Of course, you will be given the option to unsubscribe in every e-mail. You can unsubscribe from intercom messages at any time via your chaynsID. You will generally only receive intercom messages if you wish to do so yourself by activating them.

7. Your rights to your data

Of course, you have the right to receive information about your data stored by us free of charge. Simply send us an email or an InterCom message. You also have a right of appeal to the competent supervisory authority and the right to data transfer, objection and restriction of processing. In addition, you can independently correct or rectify incorrect data in your chaynsID area and/or the site. Personal data will be deleted if you expressly request this or if storage is no longer required for the purpose for which it was stored. A complete deletion may only take place after the expiry of deadlines, which are relevant due to tax and commercial law requirements. We reserve the right to demand further evidence if the identity of the claimant is not clear.

You can delete your chaynsID yourself online in your chaynsID area.

You can delete your chayns site yourself in the administration of your chayns site.

Your registration data and your personal data are protected with your personal access data and are therefore only accessible to you. To maintain security, we recommend that you do not share your password with anyone and that you change it regularly.

8. Will personal data be passed on?

We assure you that Tobit.Labs will neither sell your personal data nor give it to third parties for advertising purposes. It will only be passed on if this is necessary to fulfill a contractual purpose. For example, for the delivery of goods, the address is required and passed on to the postal service provider. Bank details are required for payment via direct debit. You can of course remove this data from your iD area after use. The data are linked to the respective purpose of the collection.

In addition, there is the possibility that the respective chayns site integrates the Google Maps map service. If you are registered with Google, it is possible for Google to use the data displayed to assign it to your Google profile. If you do not want this, we recommend that you log out of Google before using it. Google itself has its own data protection declaration for data processing, which applies to all of its services and thus also to Google Analytics. You can find it here

9. Data collection not carried out by Tobit.Labs

The operator of this site (which can be found in the imprint) can collect data independently and without the knowledge of Tobit.Labs, for which he is responsible for collecting, processing and using. Tobit.Labs has no influence whatsoever on the scope of the data collection by the operator and does not come into contact with this data in any way. This option exists because chayns offers the option of adding additional content via an interface (API). In this case, the publisher, which results from the imprint, is responsible for any additional information regarding data protection aspects.

10. Data that we collect based on usage (tracking)

In principle, you can use our products without providing any personal information. Certain data may be collected automatically and stored in log files to improve the products and user experience. The tracking data includes the IP addresses, the browser type, the Internet service provider (ISP), the URL accessed, the operating system, as well as date and time information. This information is used to analyze trends, to track user steps when navigating the website and to evaluate for statistical purposes. This is also based on our legitimate interest in accordance with Art. 6 Para. 1 lit.

For the anonymous determination of this statistical data, Tobit.Labs uses Google Analytics in its anonymous application in almost all of its platforms and products, this means that the IP address of the user is not transmitted to us in full, so that a conclusion for Tobit. Labs on the person is impossible. These are determined exclusively for the permanent improvement of Tobit.Labs products, this is done on the basis of our legitimate interest according to Art. 6 Para. 1 lit f DSGVO. Individual users remain anonymous because Tobit.Labs does not and cannot assign them. You can prevent this by using extensions for your browser, for example, that do not allow this use. The tracking or analysis data will be deleted when they are no longer required to achieve the purpose.

If the site is not operated by Tobit.Labs (the operator can be found in the imprint), this operator can also use Google Analytics. The respective operator is responsible for data protection-compliant use and the settings in the Google account.

In some of our emails or newsletters we use a so-called "click-through URL" that is linked to online content. If you click on such a URL address, you will pass through our web server before you reach the actual target website. This would enable us to track your interests in order to measure the effectiveness of communication. However, we do not follow up or evaluate this data. If you want to eliminate this possibility, simply click no text or graphic links in emails. This is also done on the basis of our legitimate interest in accordance with Art. 6 Para. 1 lit f GDPR.

11. Social Media

If you run a chayns site, you can link it to other sources such as Facebook, Twitter, Instagram or Youtube and thus ensure that the content of these sources is synchronized with your chayns site. The inclusion of other sources is voluntary. For the link, it is technically necessary for a connection to be established between the servers of Tobit.Labs and those of the sources to be synchronized so that the content of the source can be adopted. In addition, it is possible to share posts published on a chayns site via other channels such as Facebook or Twitter. If you use this function, the respective medium can possibly assign your visit and data will be collected by the medium. If you do not want this, do not share any content in this way and log out of the medium before you visit. In this context, the respective data protection provisions of   Facebook   and   Twitter apply.

12. How do we ensure your data is protected?

Tobit.Labs takes technical and organizational security measures to protect your personal data against accidental and unlawful deletion, alteration or loss and unauthorized disclosure or unauthorized access.

All interactive web portals based on software from Tobit.Labs use the industry standard HTTPS (HyperText Transfer Protocol Secure) for encryption. In this way, we ensure the confidentiality of your personal information and all account or credit card information for transactions over the Internet.

You too can help us protect your personal information by taking appropriate precautions. Change your password more often, make sure you're using a good antivirus solution, and always use a secure web browser.

Some sites use links. Please note that clicking on the links will take you to a new website which may have different privacy policies. We therefore recommend that you read the safety regulations on the relevant page before use. Tobit.Labs is not responsible for the content of the websites. If you don't want to take that risk, just don't click the link.

13. And what about cookies?

As usual on many other websites, chayns also uses cookies. These so-called cookies are identifiers that enable us to recognize your computer on your next visit. They also make it possible for you not to have to log in to password-protected portals again and again and to save your password. If you do not want this service, please set your Internet browser so that it deletes cookies from your computer hard drive, blocks them or warns you before a cookie is saved. Alternatively, you can also use your browser in an incognito mode so that no cookies are created. The cookies are stored locally with you, so you have full control over the creation and deletion. Cookies are used by Google Analytics and Google Translate. Google Translate serves as a translation option for the respective chayns site into a selectable other language. In both cases, the corresponding legal basis for optimization purposes is the legitimate interest according to Art. 6 Para. 1 lit f GDPR. The SSO data (see point 3) are also saved locally as a cookie. This contains your access token. With this token (key) it is possible to log in again without registering again. This serves to simplify and optimize the user experience, which is a legitimate interest under Art. 6 Para. 1 lit f GDPR.

14. Possibility of traceability during the Corona pandemic

chayns sites have the possibility to trace back their users. When the user scans the respective calling code, the site receives the first and last name, the profile photo, the time and the corresponding location of the calling code. This serves exclusively for the necessary traceability, which is to be recorded, on the basis of the corresponding corona protection regulations of the federal states in connection with Art. 6 Para. 1 lit c GDPR. The data will be completely deleted by Tobit.Labs after the respective period chosen by the operator of the site; after four weeks at the latest. A separate transfer or other processing of the data does not take place, of course. The user himself receives a transparent insight into his respective scanned calling codes in his personal chaynsID area.

15. Data processing regarding corona.chayns.net

With regard to the rapid corona tests, the results of which are sent digitally via chayns, all processing takes place on the basis of Art. 6 Para. 1 lit b, c, e and f DSGVO. Only a negative test result can be viewed by third parties for 72 hours, provided this option has not been deactivated by the user in the wallet under the options. Visibility makes it easier for the user to check in at places that have restrictions and shows others that the user is actively supporting the fight against the virus through the test. After 72 hours, this ad will automatically disappear.

16. Privacy Regarding Other Tobit.Labs Products

16.1 david
When using david, Tobit.Labs does not come into contact with your data unless you send it to us, which is not requested. Exceptions to this are when registering your contact details and your payment details to enable invoicing and payment. The data is thus requested and stored to fulfill the contract. The deletion periods under commercial law therefore apply. Data processing takes place on the basis of Art. 6 Para. 1 lit b GDPR. david offers the possibility to log in with his chaynsID login to establish a connection between david and chayns. However, the other principles of this data protection regulation apply, because this link does not result in any extended possibilities for data collection or transmission. Data sent by david services, such as the Link Check, is completely anonymized beforehand and does not allow any conclusions to be drawn about the person behind it. The david client offers the option of video conferencing: If there are only two participants in the conversation, the data is transmitted directly between the people - encrypted end-to-end, of course. If there are several participants in the call, the encrypted data transmission also takes place via the Tobit.Labs servers and, if necessary, contract data processors. Tobit.Labs ensures its own high data protection standard through corresponding order processing contracts. There is no reading or analysis of the data. Tobit.Labs cannot draw any conclusions about personal information. The data processing takes place on the basis of Art. 6 Para. 1 lit b DSGVO.

16.2 wayter
wayter software is based on chayns. The principles of this data protection declaration therefore apply. When you register, your name, address and payment details are collected so that billing can take place. The data collection serves to fulfill the contract according to Art. 6 Para. 1 lit b DSGVO and thus the commercial law deletion periods apply.

16.3 djukebox
When registering the djukebox, your name, address and payment details are collected so that billing can take place. The data collection serves to fulfill the contract according to Art. 6 Para. 1 lit b DSGVO and thus the commercial law deletion periods apply.
